I am searching for any information about Sheriff Samuel Stewart. He was married to Alma Clark. I found info that he had the gallows built by the Sierra County Courthouse for the execution of James O'Neill (November 27, 1885). He later went into the sawmill business. Does anyone know anything more about him? Did they have children? Alma lived in Roseville (early 1920's) after his death but I don't know when, where or how he died. Thanks for any information.

I am forwarding a copy of this posting to Lee Adams. Lee is the current sheriff of Sierra County and is an avid historian and genealogist. His department may have information about previous sheriffs. (I assume from your post that Samuel was the Sheriff of Sierra County.) You may also want to check with the California State Sheriff's Association. They were established in the late 1890s and may have information as well. Their office is in West Sacramento and their web site is at: http://www.calsheriffs.org/

The Sierra County Clerk-Recorder (located at the courthouse in Downieville) has vital records, land records, mining records, etc. The Superior Court (upstairs) has naturalization records, probates, etc. Sierra County has birth records from 1857, marriage records from 1852 (when the county was formed from Yuba County), and death records from 1864. Some of the early records are incomplete but are well worth checking. They are almost all indexed!!

I live in Roseville (Placer County). If you are not aware, Roseville is just east of Sacramento and about two hours from Downieville. I go up when I can to do research (my g-g-grandparents arrived in Sierra County in 1859 and spent the rest of their lives there).

If you have any additional details, please send them to me. If you live outside of the area, I'll see what I can find when I go up next time.

I do know tht Sam Stewart had at least one child and as of 1988, she was still living. We had a dedication of the gallows as a state registered historic landmark upon its restoration that year and Sheriff Stewarts daughter and granddaughter were both present. In fact, the granddaughter assisted in the plaque unveiling.

I will go through my records and see if I can locate the granddaughters name and get you two in contact. I would rather not post her info here without permission, so feel free to email me at hangman@jps.net

On March 18, 2002 I visited the courthouse in Downieville and checked the Sierra County CA birth, marriage and death record indexes. The Sierra County Clerk-Recorder has birth records from 1857, marriage records from 1852, and death records from 1864. The early vital records are incomplete (not everyone registered the event). I did not check the actual record but only the index, which is available for birth, marriages, deaths, and various other county records. I found the following:

The gallows is located next to the courthouse. The plaque next to the gallows reads:

"SIERRA COUNTY SHERIFF?S GALLOWS

ON NOVEMBER 27, 1885, 20 YEAR-OLD JAMES O?NEILL WAS HANGED FROM THIS GALLOWS FOR THE AUGUST 7, 1884 MURDER OF WEBBER LAKE DAIRYMAN JOHN WOODWARD. THAT EXECUTION, CONDUCTED BY SHERIFF SAMUEL C. STEWART APPROXIMATELY 100 FEET WEST OF THIS SITE WAS THE LAST LEGAL EXECUTION IN SIERRA COUNTY AND THE ONLY TIME THIS GALLOWS WAS USED. CHANGES IN STATE LAW IN 1891 ENDED LOCAL EXECUTIONS IN CALIFORNIA AND FURTHER CHANGES IN 1941 ENDED HANGINGAS A MEANS OF LEGAL EXECUTION WITHIN THE STATE.

CALIFORNIA REGISTERED HISTORICAL LANDMARK NO. 971

PLAQUE PLACED BY THE STATE DEPARTMENT OF PARKS

I went by the Downieville Cemetery on March 20 and located the following grave. I wasn't able to search much as there is snow on the ground.

I am researching Alma Clark's family. Alma Clark was my great aunt. I knew she married Samuel Stewart, and I have also been looking for the names of their children. I read the replies you had received one of which listed Frank G. Stewart as a son. It was nice that you were given that information through the E-mail. Have you found anymore information on the children, i.e. the one woman that is possibly still living? Do you have any information on Alma that I could use?

My husband's great grandfather was Alma Clark's brother. I was able to get in touch with Alma's great granddaughter, who is 80 and lives in Sacramento. She is a sweet lady and I have enjoyed speaking with her. She gave me a copy of her family tree handwritten by her grandmother. We shared some photos and I hope to visit her some time soon.
