The following document was found in a bundle tied up in a tin box in the court house at Shelbyville, Kentucky. It is identified as II 85, No. 9.:

"To the Honorable Judge of the Shelby Circuit Court in Chancery sitting Your orator Richard Neile one of the heirs of Samuel Neile late of Shelby County deceased respectfully states that said Samuel did on the day of possession of certain slaves to wit Moses, Caroline, Iona, Ann Peter one half of which your orator was entitled to. That after the death of said Samuel a certain Barton Brown came from Kentucky to the state of Maryland and falsely and fraudulently represented to your orator that said Samuel was nearly or perhaps quite insolvent and that the negros he had left were almost a burden to anyone to keep them that the negro woman was helpless and two of the children entirely unservicable and that said negros was almost valueless and that this your orator's brother Samuel aforsaid was considerably indebted to grog shops and other places by which false and fraudulent representations said Brown induced your orator to sell to him his right to said estate that said Brown fraudulently informed before your orator thos is one old man and had no knowledge that his statment so made was false that your orator by such devices of the said Brown sold his interest in said slaves for about twenty five or thirty dollars which sum said Brown falsely and knowingly declared to your orator to be their full value that your orator believes from information that said Brown left Kentucky for the purpose of cheating your orator or is above obliged That since then a certain Benoni S. Newland has administered upon said Samuel's estate and now has said slaves in his posession Your orator makes said Brown and Newland defendants hereto and may they be required fully to answer the allegations of thes Bill as distinctly as if the same were put by way of special interrogatories and now said sale of your orators interests to said slaves to said Brown be set aside and held void and may your honor compel said Newland to distribute and portion to your brother his rightful

portion of said slaves and if the said slaves cannot be divided in kind between your orator and James Neile, Zachariah Neile, and Brown, Mary Moore, William Neile and the infant children of Richard Neile, James Neile, Fielding Neile, Richard and John Oakley Neile, Inenino Brown an infant child of Ignatius Brown his wife Elizabeth, all of whom are co heirs and co Distributers with your orator and each made defendants in this bill Then may your Honor decree a sale of the same and decree to your orator his slaves thereof and may your Honor grant to our brother such other and further relief as in equity he has a right to demand as the premises considered belongs to him In consideration of all which may the Commonwealth writ of Subpoena be granted directed according to the prayer herein and your orator repayed
