The family of the late Laurence Wolfgang of Mowry, who died of a fall from the second floor of the post home of the Walter H Wardigo American Veterans of World War II Post No. 7 113 South Main Street Shenandoah April 29, 1951 has instituted suit for $100,480 against the post and six of its officers and members.
The suit asks $100,000 for loss of support for his family that Wolfgang would have expected to earn had he lived. An additional $480 is asked for funeral expenses.
A complaint filed by Attorney Richard Holohan, Pottsville, and Attorneys Richards Dilworth and Harold E Kohn, Philadelphia, said that Wolfgang was present at the post home at 6 pm on the day of his death and that:
“Defendant association, acting by officers and members and individual defendants, in order to stop an alleged fraud against the defendant association by the decedent, compelled him to go to the second floor of the defendant veteran’s post and thereupon negligently, carelessly, and recklessly caused his death by causing him to fall from the window thereof to the sidewalk.”
In addition to the post, the following are named as defendants:
Edward J Daley, 121 South West Street, Shenandoah, service officer, and member of the post;
Ben Skobel, 215 North Jardin Street, Shenandoah, chairman of the House Committee and member of the post;
John Romanek, 219 West Lloyd Street, Shenandoah, member of the post;
John Sincavage, 850 West Coal Street, Shenandoah, member of the post; and
Boley Milewski, 10 North Carbon Street, Shenandoah.
The suit says the defendants at all times “were acting on behalf of the defendant post in discharge of their duties as officers and members and in the scope of their employment as servants, agents, and employees of said post.”
The suit is on behalf of the widow, Alice Wolfgang, as trustee for herself and nine children.
The children are Elizabeth, Joan, Charles, Alice, Mary, Louis, Agnes, Harry, and Laurence Wolfgang, all of Mowry.
