Need help--possible surname change

I'm trying to figure out my great great grandfather's family info. There is some confusion with records and it leads me to believe there may have possibly been a surname change. According to records he was b. in Putnam co., IN. I'll list what I have:

John Henry Justice (last name originally Henry?) b. 11 Aug 1838 Putnam Co., IN and d. 30 Dec 1906 St. Bernice, Vermillion co., IN. he m. (1) 27 feb 1860 Fountain Co., IN to Sarah KELLEY b. abt 1846 IN. the marriage cert. is filed under the surname HENRY, but when he enlisted in the Civil War in 1861 he was a JUSTICE. and m. (2)28 Dec 1873 New Brunswick, Boone Co., IN to Mary Elizabeth WEBSTER b. 4 Jul 1843 Chatham Co., NC and d. 31 Jan 1911 St. Bernice, Vermillion Co., IN.

on John's death cert, his son lists John's parents as Hiram Justice and Emily Vest. I have found a marriage cert for Hiram Justice and Ann Vest 9 Dec 1833 Putnam Co., IN but can't find any more info on them. According to census records, John's parents were b. PA (father) and IN (mohter).

I can not definativly find John in the 1860 or 1850 census records, but in 1861 he was in Covington, Fountain Co., IN and in the 1870 census he was in Fulton, Fountain Co., IN.

My family has always refered to him as John Henry, and i don't know if it's just because that's his first and middle name or if Henry was an original surname or why he would have changed his name if he had. i know there was a large population of Henrys in Putnam Co. so this further adds to my confusion.
